By visiting our site/social media outlets and/or purchasing anything from Mindful Mama Matters, LLC (“MMM” or “our” or “we”) and/or selling Young Living Essential Oils (“Young”) or other products or services as part of our upline or downline program, you agree to be bound by the following terms and conditions (“Terms”) of this Agreement. These Terms apply to all users of the website/social media outlets, including but not limited to users who are browsers, vendors, customers, merchants, and/or contributors of content. Additional Terms, including Terms referenced herein and/or available by hyperlink, apply to you if you are one of our downline purchasers, users and/or resellers. ASSUMPTION OF RISK. Accordingly, you and your clients, patients and customers must use the Products AT YOUR OWN RISK, recognizing that there is a chance that allergic reaction, illness, injury or even death could result. If you and your clients, patients, and customers are not willing to assume all of these risks, you and they must not represent, promote, sell, or use the Products.
LIABILITY RELEASE, HOLD HARMLESS, and INDEMNIFICATION AGREEMENT. By using the website and/or social media outlets, or by purchasing, using, selling, recommending or representing the Products, you agree to RELEASE MMM (including its members, managers, principals, employees, and agents, collectively “MMM” for purposes of this entire Agreement) from any and all liability, claims, damages, costs, lawsuits and other legal or equitable actions, resulting or arising from, or relating in any way to, the website/social media outlets, the Products, or from your or any individual, company or entity’s use, sale, recommendation or representation of the Products. In addition, you agree to hold MMM harmless, and to indemnify MMM for any and all costs, expenses, damages, fines, legal judgments and awards, and expenses (including the cost of MMM’s attorney fees and other legal defense costs) in the event MMM is sued or claims are made against MMM for any violation by you of these Terms (including the additional Terms and Conditions available via hyperlink).
Limitation of Liability You agree that MMM’s liability to you is absolutely and strictly limited to the refund, if appropriate, of the cost of Products returned by you to MMM or to Young. You agree that in no event will MMM be liable to you or to any other individual, company or entity for any type of damages, including direct, indirect, consequential, incidental or special damages, whether for economic loss, reputation or business loss, loss of opportunity, loss of profits, physical or allergic reaction, emotional or psychological upset or disturbance, illness or death.
Law of Pennsylvania/Location of Suit in Pennsylvania. You agree that this Agreement, your use of the site/social media outlets, and your purchase, use, sale, recommendation or representation of the Products, will be governed by the laws of the Commonwealth of Pennsylvania (not including its choice of laws rules), and that any suit or other legal or equitable action brought by you or your customers, patients, clients or users against MMM will be brought, if permitted at all, only in courts located in Lehigh County, Pennsylvania.
WHEREFORE, expressly intending to be legally bound, you agree to all parts, Terms and Conditions of the above Agreement, without which agreement by you, you are not permitted to use the site/social media outlets, or to purchase, use, sell or represent the Products and Services.
